REFUND & CANCELLATION POLICY

Effective Date: December 22, 2022

Support Email: support@codingwise.in

This Refund & Cancellation Policy (“Policy”) is a binding component of the Terms & Conditions of CODING WISE, a training and placement assistance academy operated under SKYUP MARKETING, sole proprietorship registered in Madhya Pradesh, India.

By enrolling in any program, you agree to abide by the conditions set forth in this Policy. This Policy has been structured in accordance with:

  • Section 2(1)(r) and Section 18(2) of the Consumer Protection Act, 2019
  • Section 73 and 74 of the Indian Contract Act, 1872
  • Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • Guidelines under the Reserve Bank of India (RBI) regarding digital payments, reversals, and service disputes
1. General Refund Principle

CODING WISE follows a "Service Accountability Standard", meaning that refunds are provided only when there is failure on our part to deliver core services that you have paid for.

Refunds are NOT provided in situations where:

  • The student fails to meet academic performance or participation standards,
  • The student defaults on EMI,
  • The student voluntarily drops out,
  • The student does not get placed despite assistance (as final hiring is company-dependent).

This model is legal under Indian consumer law, so long as:

  • Policies are disclosed pre-purchase (which we do),
  • Acceptance of terms is recorded (via digital acknowledgement).
2. Services Covered by This Policy

This Policy applies to the following services sold by CODING WISE:

  • Paid short-duration workshops
  • Long-duration high-ticket career programs
  • Placement assistance services connected to those programs
  • Certification modules bundled with live or recorded sessions
3. Refund Eligibility (Strict and Limited Conditions)

You may request a full refund ONLY if all of the following apply:

  1. CODING WISE fails to provide access to the training program you enrolled in, and
  2. CODING WISE fails to initiate placement assistance, defined as failure to arrange even one direct interview or referral opportunity to a hiring partner, and
  3. You have submitted the issue in writing to support@codingwise.in within 10 calendar days of the service failure.

These conditions must be met cumulatively. Partial delivery of services nullifies the refund claim unless agreed otherwise in writing.

Refunds under this category will be processed within 15 business days via the same payment mode used during enrollment.

4. Refund Not Applicable – Situations that Exclude Refunds

Under the principles of reasonable limitation of liability and performance-based contracting under the Indian Contract Act, the following cases are explicitly excluded from refunds:

a. Performance-Related Exclusions

  • The student fails to attend at least 75% of live classes or complete equivalent LMS modules.
  • The student scores less than 60% in internal assessments or mock interviews.
  • The student is absent for scheduled mocks or interviews without documented reason (medical or emergency).
  • The student receives placement assistance but fails to crack the interviews conducted by the company.

b. EMI-Related Exclusions

  • If the student opts for an EMI plan and fails to pay EMI on time, access to course materials, LMS, placement assistance, and support is revoked without refund.
  • CODING WISE is not a loan provider and is not responsible for EMI disputes between student and the EMI provider.

This clause is consistent with RBI regulations and private education loan norms.

c. Voluntary Withdrawal

  • If a student withdraws voluntarily, no refund shall be provided irrespective of service usage.
  • The withdrawal must be submitted in writing. Lack of usage is not equivalent to cancellation under law.

d. Change of Mind / Buyer’s Remorse

Refunds are not issued for “change of mind” after access to course has been granted. This is consistent with Indian e-learning norms and global SaaS policies.

5. Partial Refunds and Proration

CODING WISE does not offer pro-rata or partial refunds for:

  • Mid-course dropouts
  • Unused live session hours
  • Missed recorded sessions

This aligns with the principle that partial service access still incurs full operational cost and benefits.

6. Refund Claim Procedure

To initiate a claim:

  • Email a formal written request to support@codingwise.in with:
    • Full name, mobile number, registered email
    • Payment receipt
    • Description of issue and grounds for refund
  • The refund team may request supporting evidence (screenshots, LMS logs, etc.)

Time Limit:

  • Refund requests must be raised within 10 calendar days of the incident.
  • Requests raised after this window are not valid.
7. Processing Timeline
  • If eligible, refunds will be processed in 15 business days from approval.
  • Refunds are only made to the original source of payment.
  • CODING WISE is not liable for delays caused by banks, UPI apps, or technical errors outside our control.
8. Legal Jurisdiction

This Policy shall be governed by the laws of India. Any disputes arising out of refunds shall be subject to courts located in Madhya Pradesh, in accordance with Section 20 of the Code of Civil Procedure, 1908.

9. Policy Amendments

We reserve the right to revise this Refund Policy without prior notice. The most current version will always be available on our official website.
